Legal Question in Employment Law in California
Inappropriately Accused
I am an employee in the state of CA. My former employer decided that it was appropriate to have my department's functions performed by an external vendor. This was announced and we were given 48 hours to sign an employee agreement with the new company. Not signing the document, we were told, equaled immediate resignation (without notice). When I did not wish to transfer my employment the new employer increased my salary by 17% and I signed. After all, two days isn't very long to find a new job!
Within a few days, I accepted a leadership position at another organization. I was contacted by former associates and many have chosen to go through the interview process at my new job and some have signed on. Never have I approached a former colleague to come to the new company.
Today I was served a formal letter from the corporation accusing me of soliciting my former colleagues. My current employer and several people I don't know were copied on this certified memo.
I have not performed the actions I am being accused of. What can I do?

Show the letter to the new company, let them handle it.
