No. Independent means they set their own work schedule. They can work how they wish, but they have to provide a lunch break for their own employees.

If your question is really relevant, there is a good chance that the "contractor" is not legally a contractor but rather an employee as a matter of law. Treating an employee as a "contractor" can be very very costly to an employer if the employee/contractor files a complaint with the state Dept. of Industrial Relations Division of Labor Standards Enforcement.
