Job Abandonment

after 2 months of being on fmla. i requested a personal leave of absence for medical follow ups that my dr would not have approved under fmla. i requested the loa from my supv who either forgot to inquire about if for me or conspired to make it appear as though i abandoned my job. i've spoken to hr who said they would look into it. this has now created a hostile environment for me to go back to work. i refused to return citing it would be too uncomfortable. hr still has no answer but has sent me a letter advising i must report to work or will be terminated for job abandonment. do i have any legal recourse?
