Legal Question in Employment Law in California

If I look for a new job while on STD, can I get in trouble?

My current job has been causing me so much stress that I had to start seeing a psychologist. We were going to put me on Short Term Disability for depression and anxiety. Before we could do this, I had to go to the hospital for a subdural hematoma and had a craniotomy. I am now on short term disability for this. The thought of going back to work for my current employer makes me ill and causes server anxiety and panic. My psychologist is going to extend my disability for depression and anxiety. I am trying to find a new job. Can I do this while still employed with my current employer - who by the way hasn't called to see how I am doing? Her daughter, who also works there has called once - when I was still in the hospital - that was 7 weeks ago.

My questions is, can I look for a new job openly? Can they fire me? If they fire me, can I collect unemployment till I find a new job?

Help.

Thanks!!

It seems that your depression is work-related. You may have a valid worker's compensation claim for stress. You may even get SDI as didability benefits. But if you start working again, this will terminate. Feel free to call us at 213.388.7070 for free consultation.
