jobs eliminated by a lay-off

I was laid off from my job in February as part of a general downsizing. I am currently recieving umemployment benefits from the state of California. Recently (may 5th) a job posting describing my job appeared on a national job search website. How long must a company wait before they can rehire for a position eliminated by a lay-off? I have applied for the job but have not been contacted. Does the company have any obligation to hire me back? Do I have any legal recourse? Can I sue for lost wages?

They dont need to wait. They can hire someone as soon as you are out the door, or even before you leave.
