Any attorney will want to know the specific facts of your situation. Was the person who verbally abused you a co-worker or a superior? Did you report the verbal harassment to a superior or to your human resources department? Did you ever report it in writing? If so, how often? If you told your superior or human resources, did they do anything about it? Did they discipline the offending employee? Did the company take any steps whatsoever to protect you? Was it bad enough for you to call the police? If so, did you or did you not call the police. How long and how many times did this person threaten you? Did anyone else witness the verbal aggression?

California law recognizes an action for hostile work environment if your employer took no action to protect you from a truly offending employee who verbally abused you. Depending on the facts, pain and suffering, emotional distress also could possibly come into play. I would also want to know the gender of the parties. Was the verbal abuse gender based? Race based? Sexual preference based? These factors all come into play.

if it is a threat of violence it can be reported to the police.
