Legal Question in Employment Law in California

Is this a labor code law?

I am currently working for a company that states you must take your meal period before the fifth hour if you work 8 or more hours is this true? And is it legal to write you up or terminate you if you punch out a few minutes later then the fifth hour?

Yes, your employer is properly complying with California law. (Wage Orders, Sec. 11) The "clock-out" requirement is in place in order that the employer can prove adherence to the law.
