Legal Question in Employment Law in California

I was laid off from my job, I was told my position was eliminated. Within 6 weeks they needed to hire someone to do the same duties. Is the employer obligated to offer my position back to me before hring someone?

Not unless it is required to do so by contract, such as some employers have with unions.
