Legal Question in Employment Law in California
Laid off ? rights & notification of termination
I was laid off from my job last winter, for what was to be a couple of weeks. I left my tools there and still retained my company equipment (cell, phone, keys, ect), which was never requested from the company. I filed from unemployment. I contacted the employer about my return and was told ''hopefully in a couple of weeks'' After the unemplyment ran out, I would work odd jobs for friends to earn money, while waiting to return to work. 11 months later, I get a call from the local police stating I am begin charged with stealing from my employer. I contacted the employer and was told it was unwritten policy to return the equipment upon lay off. I asked why I wasn't notified or told that there would be no return to work, they couldn't give me an answer. I returned the phone. Am I responsibible for charges on the phone and can I be compensated for pay for not being able to work, due to possible return. Didn't they have to notify me that the lay off was to be permanent?

Re: Laid off ? rights & notification of termination
If you incurred charges on the phone, you are responsible for those charges. As far as the layoff goes, you obviously believed it would be a while since you exhausted the entire unemployment compensation pay period. I hope the police matter gets straightened out as a misunderstanding.
