Legal Question in Employment Law in California
Lay offs and severance payouts
I recently got laid off with another 150 employees and they offered us two weeks if we signed this document that eliminated all of our rights. What are the requirements for the two month severance package that I heard about on a radio show? I was with the company for 3 years--for what it's worth.

Re: Lay offs and severance payouts
Unless your employer has a contractual obligation to pay severance, there is no legal duty to pay any amount. If there is a contractual obligation, which may be found in your employee handbook, you should get the benefit without having to sign a release. If you do not have any reason to believe that your layoff was unlawful, you are not giving up anything of value by signing the release.
