Legal Question in Employment Law in California

Layoff laws---rehiring.

Do we have to rehire an employee we laid off if work becomes avaiable? We reduced an employees hours to 20hrs a week. He has also taken on a full time job. If work comes available when he's working at his full time job, do we have the right to hire another part time employee to cover those hours?

Assuming the reason you do not wish to rehire the employee is not an unlawful one (discriminatory, retaliatory, etc.), you have the right to hire anyone you wish.
