Legal Question in Employment Law in California

Layoff while 7 months pregnant

Hello,

I really hope you can help me with this urgent issue. My wife is 7 months pregnant and was just informed that her posistion is being "phased out." Coincidentally, its going to happen right when she was planning to go on leave.

Is this legal?

Are there precedents set for how much serverence she should get - right now they've given her 3 weeks! I find that hard to take.

Is there the posibility that we could collect damages for the stress and sleepless nights it is causing my wife, not to mention what it could be doing to our baby.

Thank you for your help.

Re: Layoff while 7 months pregnant

California is an at-will employment state meaning they do not need a reason to lay her off. The law does not require severance pay at all so she is lucky to get the 3 weeks.
