Legal Question in Employment Law in California
Is this legal?
A company employee was physically abused by her boyfriend and had to miss work to recover. My boss, the business owner decided to pay her while she was out (she is salaried). When I hypothetically asked him if he would pay an employee that asked to take personal time off he said no, he would not pay them. He stated that as the business owner it was his right to pay someone or not based on his assessment of the situation. Is this indeed his right? Can he pick and choose when he will or will not pay an employee missing work without this being a violation of some type of employment law and/or discrimination? I am concerned about his cavalier attitude and likewise concerned he will alienate me for not ''caring'' about this employee's personal circumstances.

It sounds like he gave this person a gift because he felt sorry for her. He should provide names of counselors to assist her with domestic violence. If it happened in the workplace, he can file for a workplace harassment restraining order against the boyfriend, who should be an ex-boyfriend.
