Is it legal for an ex employer to continuing advertising the ex employees name on its company phone message machine

Probably it is legal. If they just have not gotten around to changing the phone directory on their answering machine then they are lazy but not liable for damages. If they are using your name to draw in business you could sue in civil court, but it would be difficult to show what your damages are.I do not think there could be any criminal charges.
