Legal Question in Employment Law in California
Is this legal?
I was laid off from my job due to ''restructuring'' I have never received negative feedback from management,orally or written. In a staff of 10 sales people I am the 3rd longest tenured. Turns out my boss, who just started at the company in the last 6 weeks has hired someone that previosly worked for him. In discussions my new manager the one time we met in person he asked as to my plans to start a family with my new husband. I am the only newlywed woman in the department. 2 weeks before I was laid off, there were some indications that a sales position was being made available here in my office. Several people called the office asking about an �open sales position�. Upon hearing this I directly asked my manager whether he was actively looking to replace me. On several occasions, he directly told me that he was not. He actually told me to stop being paranoid. It now appears that this was a lie. While I understand that the company is taking the position that the organization is being restructured, I think it could be argued that there is really very little that is going to be restructured.
Is it inappropriate to actively recruit for a position while someone is still there...as well as to lie about the security of your job?
