is it legal to not pay minimum wage if a person is on commission?

No. That is illegal. You can recover the minimum wage plus a penalty of $100 for the first pay period there was a violation and $250 for each of the following pay periods. You can also recover interest, and the employer must re-pay your attorney's fees.
