Legal Question in Employment Law in California

Can a limo driver, who is an employee of a limo company in CA, take an employer to court if they refuse to compensate a driver for dry cleaning as a business expense in the same manor that California law demands that they reimburse for the expense of having you use your cell phone while on duty? In my case, I had to wear black pants and a white collared dress shirt with a tie that was supplied by the company. Can I recover dry-cleaning expenses just for the shirt? Or for the pants too? What if the employee was an independent contractor instead? Does being an independent contractor shield a company from their responsibility to reimburse for business expenses? Can drivers who are required to wear fancy clothes like suits require their employers to reimburse for either the purchase price or the dry-cleaning?

It's difficult to answer your question without more information. For example, did the company require you to dry clean your shirt/pants or was it possible to clean them by putting them in the laundry machine with other clothing? Did the company classify you as an employee or an independent contractor? (If the latter, you may have other claims.)

You should discuss your case in detail with an employment attorney. Many of us offer free consultations and take cases on contingency.

Good luck.
