Legal Question in Employment Law in California
How long before it's too late to file a claim
When is it too late to file a claim for wrongful termination? There was written warnings in my file that stated '' Refused to sign''! How am I supposed to refuse to sign when I never was presented with these warnings. They flat out lied! It's been bothering me for 3 years! So I maybe too late!

Thank you for your inquiry.
I can tell from your posting youare are frustrated, but to answer your question directly, A 1-year statute of limitations governs all causes of action in a wrongful termination case. Cal. Gov. Code 12960; Cal. Civ. Proc. Code 340(3).
There may be longer statutes that allow you to still bring a claim, such as breach of a written contract, but I can't tell that from the information you've given.
I hope that this information helps, but if you have other questions, need more information, or feel that you need legal representation, please feel free to contact me directly at [email protected]. I am happy to help in any way that I can.
