Legal Question in Employment Law in California

Maximum Days Worked In a Row

I am unclear about the legality of some of the work schedules that have been imposed on myself and my fellow co-workers. I know that california law says that no employer may schedule an individual more than six days in seven. However I am unclear if those days carry over into a new week. Suppose I didn't work on Monday and Tuesday of my first ''work week,'' but then proceeded to work the remainder of the first week and didn't get a day off until friday of the next. I am unsure if that is legal, because the days are spilt between two different weeks. The way that I was scheduled would mean I would have worked nine days straight, definitely more than 6 days without a day off, Never more than five days in the same week though.

Re: Maximum Days Worked In a Row

Each work week stands on its own. A work week is a period beginning at a specific day and time and ending 7 days later. So if the days are in different work weeks, even though consecutive, you are not entitled to premium pay.
