Legal Question in Employment Law in California

Medical appointments

I work for a small owner run insurance agency. I am the only employee. My employer has insisted that when I need to make a medical appointment I must first tell her I need to see the Dr, what I need to see the Dr for, and then sit down with her and make my appointment at HER convenience, not the Dr's or according to my medical condition. I have also been made to cancel existing appointments if something comes up on her schedule.

Is any of this legal? I thought my medical reasons for treatment were private and not the business of my employer.

Re: Medical appointments

You should not tell your employer the reason for your medical appointment, although probably she wants to make sure it's legit. Obviously, scheduling is a problem for her, so let her know way in advance if at all possible.

Re: Medical appointments

The reasons for your medical appointments are your business and under a number of State and Federal laws are protected from disclosure. However, your employer is in control of the schedule and may require you to schedule matters that are not an emergency at the company's convenience. If there is a medical reason that a Dr appointment must take place at a specific date and time, get a note from the doctor that says that (without and diagnosis or prognosis).
