Legal Question in Employment Law in California
My mother worked as a care giver for a woman who was under the direction of social services (she's mentally incapable of taking care of herself). Social services allowed a man to have power of attorney for the woman and manage her finances. My mother was notified that on June 29 she was terminated along with the man who had power of atty. She was written her paycheck on June 30 and it was mailed to her by the old power of atty. The woman my mother cared for had hired an atty so she could manage her own finances. This new atty closed the account that my mothers check was written on and the check bounced. My mother spoke with the new atty and was informed she would have to look into it. This is a huge financial burden on my mother. What should she do?

Immediately call the new attorney and demand that the check be made good and the bounced check charge be reimbursed. point out your mother's situation and that it was negligent to close the account before al the checks had cleared.
If the new attorney will not make good on the check immediately, your mother should report a bad check case to the police, and file a complaint with the Dept. of Industrial Relations, Division of Labor Standards Enforcement.
