Legal Question in Employment Law in California
Motorcycle Stolen from Work
My motorcycle was stolen from the front of the buliding where I work, we have a security guard which stays in the building and cannot see our parking lot. The motorcycle was really close to the front doors yet nobody knew it was missing until I found that my bike was gone myself. I was wondering is it possible that by employer is liable for what happened to my bike? I'm upset because they know we have a hugh problem with theft in our parking lot and nothing is being done to prevent it. Please help!

Re: Motorcycle Stolen from Work
Your employer is not legally responsible for the theft of the bike unless it owns the property you work at, and then you must be able to show they were negligent.
If the owners of the property were aware of the danger of theft, you may be able to hold them responsible, if you can prove negligence on their part. Check police records to determine the frequency and nature of thefts on the property and the adequacy of security they provide to protect your property.
