Can I negotiate a severance agreement if my Employers CEO said I'd be able to get one? My position was elimated and I was forced to take a position I didn't want. I did file a racial discrimination claim that is pending. Currently I'm on short term disability and I can't negotiate until I go back, but I don't want to go back, it's hell there. I would just like to negotiate a severance now but my employer didn't want to until I went back, so what can I do?

An employer is not required to pay severance pay unless there is a written contract specifying so or the employer has a set policy of paying them. With any severance agreement, you will, almost always be required to sign a waiver of any and all claims, which I think would include your pending claim of racial discrimination.
