Legal Question in Employment Law in California

non compete contract

I work for a Learning Center in California and signed a non compete contract. I have been offered a position from another tutoring company in Illinois. Although the company I work for now is a nationwide company, I work for a small franchise owned by local owners, not corporate. Since the new job is so far away, do I have to worry about my non compete contract?

Re: non compete contract

Most such agreements, if not all, are routinely struck down and found to be unenforceable by California courts as they are against public policy and impose undue restraint on trade. Thus, it's very likely that you don't have much to worry about, as long as you don't disclose confidential information/trade secrets of your current employer, if there are any.
