Legal Question in Employment Law in California
Non discriminatory harrassment at work
This past year I had befriended a female at my work but tried to pull away POLITELY as she got obsessive with personal questions. Since then she has started the glares, muttering under her breath AT ME in English and in her language, she sees me alone in the restroom, slams things down, SLAMS into the stall, mutters under her breath at me, has literally brushed passed me glaring AT me, I've changed my schedule, where I walk at work. I've spoken to my boss twice, her boss and HR about this. They called it a ''personality'' conflict, a ''body language'' thing. She only does this when we are alone, has done it on the way home, she's stomped passed me glaring and muttering at me, asked my co-worker about me repeatedly ''how's your little friend'', asked this same person when I was out for a procedure, ''mutter boob job'' about me being out. It has stopped since I talked to HR but now since she has talked to HER manager I am concerned about reprisals. It is very uncomfortable working there. HR said to contact them again but I think if reprisals occur I need more guidance. I don't go to my boss anymore because every time it's been brought to a personal level that ''this person is so nice''. I don't know where I can turn to for help anymore.

There really is not much you can do at this time. You should try to work within the organization to get away from her or find another job or you can try to speak with this person and see what is bothering her. You should point out to the HR person how the situation is effecting your work, that you feel harassed and, if it is true, you feel unsafe working with this person and continuing to do so is causing you anxiety, stress, sleep loss and a need for counseling.
Good luck to you-Martin
