Legal Question in Employment Law in California
Non-Discloser Agreement
If a company uses a new product, but it is not kept confidential from there customers, can the company come after a past employee for inquirering about the product.(recieving brochures, etc...)Give in mind that the past employee works for another company in the same industry dealing with the same customers. The customers have mentioned the new product to the competitors of the past employer.

Re: Non-Discloser Agreement
If the product is in the public domain and you had no inside knowledge of the way it was created or the research behind it, I see no reason why you -- as a member of the general public -- should not have as much knowledge of the product as anyone else. It depends what the company is alleging was disclosed. Based upon the question, it is hard to formulate a solid opinion. Feel free to write or call to discuss it further. -Robert F.
