Legal Question in Employment Law in California

Notification of Termination

I have recently found out that my manager terminated me

through a coworker. It just so happens that she scheduled

me without knowledge, and when I did not show up, she just

started telling my coworkers i was terminated. She never

contacted me informing me of this event, not that i was

tardy nor of my termination. She then starts slandering me

to my coworkers, one of whom is a friend and relayed the

information. I came into work for my next scheduled shift

and she is conveniently absent. So I have to call her from

work and confront her about the situation, in which some

words were exchanged and she claims I am no longer an

employee. Don't I have to be notified of termination? and

doesn't she have to report grounds for termination to me

before just firing due to dislike?

Re: Notification of Termination

from the facts given thus far, yes you would need some form or formal or informal notice that you were being terminated for it to be effective. further, if your co-worker was making false statements about your work performance,etc...you would have a cause of action for wrongful termination, defamation of character, and/or invasion of privacy. if you would like further legal assistance and/or representation on this matter, please email our law firm today with more specific details pertaining to your case.
