Legal Question in Employment Law in California
On October 4th, 2009 I got my review from my job. I got raise. I got 1/2 the raise plus back pay in late December. I'm still waiting for the rest of the raise plus my back pay. Since October I have been after my companies HR about this and no one wants to help. I went to 4 mangers 6 times and nothing. I've even filled out a request to see my review that in my file from October 4th, 2009 and nothing. (I want a copy of my review that has my signature and my manager's signature right next to the spot that says I got the raise.) I'm going on month 6 on April 4th, 2010. Can I sue? I'm about ready to quit. There are times I work 4 hours without a break, sometimes 4 and half hours. Last December I worked 6 1/2 hours without a break. I'm at my wits end. (I'm looking for another job.)

In California, the Division of Labor Standards Enforcement (DLSE) will handle complaints for unpaid wages and a lack of proper breaks. Here is their website: http://www.dir.ca.gov/DLSE/. It will not cost you anything to use their services.
If you are thinking about just quitting your job, check with the Employment Development Department (EDD) and find out if they would pay benefits if you voluntarily left in this situation. The EDD is at http://www.edd.ca.gov/
