Legal Question in Employment Law in California
I have an older brother who works in India as a voulunteer and has been diagnosed with Parkinson's disease. Would I be able to take a 12 week unpaid leave from my job as an RN in a private California hospital under the Family Medical Leave Act and have my position held for me ?

If it can be certified that your leave is necessary to provide medical care for your brother and you meet all of the other eligibility criteria (i.e. you were a full-time employee with the employer for at least 12 months and they employ 50 or more people within a 75 mile radius of where you work), you should be able to take FMLA leave. You need to discuss this with the human resource manager at the hospital you work at.
