Legal Question in Employment Law in California

overpay garnishment

The company I work for does'nt compensate for sick and personel days off. Payroll has however been paying me for the last year and a half.I recently noticed this in late May,and brought it to my supervisors attention. The payroll dept.has now started taking money out of my check to pay this back.I was also told to sign an agreement(which i did)

stating that they could do this. The amount of the mistake was $1800. Can i take any action agianst the company I still work for? Should i talk to my union rep?

thank you

Re: overpay garnishment

If there is an actual overpayment, the employer is entitled to a return of the overpayment. However, you should talk to your Union Rep. the Union contract may provide some coverage for you. Otherwise, you have no claim against the employer
