Legal Question in Employment Law in California

Overtime Compensation

I recently worked a large amount of overtime due to an event my organization held. My boss came to me and said that it would be very expensive for the organization to pay me for all that overtime (I don't make a considerable amount as it is) and that she would have to ask me to take at least some of it as comp days. I don't make a lot of money and I would prefer the cash. Can she legally ask me to do this? Thank you

To answer your question - no, your employer can't ask you to use comp days and he/she has to compensate you for overtime. Failure to do so is a labor code violation that would result in penalties against your employer.
