Overtime in Municipality

I work for a city on a 4/10 workweek as a temporary non-exempt employee. The 4/10 workweek was adopted by the City Council, not the employees. When I worked 9 hours one day and 13 the next, I was paid overtime for only 2 hours, since the payroll dept. carried over one hour of regular time to the next day. This is the second time this has happened. The payroll dept says the government is exempt from certain labor laws. I thought overtime was calculated daily, with a threhold of 40 in a week. Also, arent' hours over 12 in a day paid at double time? Thanks.

You should be paid for your overtime. I suggest you go to the labor board seeking what you feel you are owed. Be sure to have everything documented.
