Overtime Pay

Should the company I work for be paying me overtime. I work 58 hrs a week with no O.T. They say they can do that under "agriculture". Its a land leveling company and a lot of the work we do looks like construction to me. Where do you draw the line between agriculture and construction.

Generally, in California, entitlement to overtime premium payments are governed by the employee's status: exempt vs. non-exempt. However, as your question states, there may be exceptions.
