Legal Question in Employment Law in California
Overtime pay for part time epmloyee
I was hired by a company for a temporary (3 months contratcted) part-time job. Per my schedule, I get very friday off, and work 10+ ours the other 6 days. My employer calculates the overtime on a daily bases - i.e. anything over 8 hrs in a day is overtime. On a weekly bases it comes out, that I work 6x8=48 hrs for base pay. Question: How does the 40 hr workweek apply to part-time workers? (i.e. anything over 40 hrs/wk is overtime)?

The general answer is yes. But in some situations it does not apply (example: collective bargaining agreements or certain resident managers, etc. . . )
