Overtime

I am a sergeant for a City Police Dept. We are required to come in 1/2 hour early to preprare for briefing. We used to get a ''sergeant'' check once a year for this time until the City decided to follow the FLSA. Now our department has said they will only pay overtime to 2 supervisors per shift, usually there is 2-3. The third one has to adjust his/her shift to avoid being paid overtime. Is this legal?

I�m not sure I understand you question the way it is worded so let me say this. They can adjust your schedule to avoid having to pay you overtime but if they require you to work extra time they must pay you for every minute you work. Does that answer you?
