Legal Question in Employment Law in California
overtime and ''workday'' hours
My company has a workday set at 12:00am to 11:59pm. However, the employees in my department are frequently required to work past midnight into the next ''workday''. The company has stated that at midnight we return to regular hourly pay. Is this legal? Are there any laws regarding overtime pay for consecutive working hours regardless of the designated ''workday''? Thank you.

Re: overtime and ''workday'' hours
It is not legal. The Industrial Welfare Commission orders provide that a workday and day mean any consecutive 24-hour period beginning at the same time each calendar day. You and your co-workers should be receiving double time for any hours worked after 12 hrs. If want to discuss further, feel free to call me at 805/641-66000.
