Legal Question in Employment Law in California

Overtime

I worked from 6am to 12:30am w/ no meal break (non-stop). My employer cut my double time off at 9pm and I then was paid regular time untill the end of my shift.

Re: Overtime

This conduct, as you would suspect, violates the law with regard to overtime as well as rest and meal periods (for which additional compensation would be owed). Feel free to contact us at (510) 891-9800 or on line at www.scalaw.com for more information about your remedies.

Re: Overtime

Not sure what your question is. If you are asking what you can do about not being paid for overtime premiums, assuming you are a non-exempt employee, go file a claim with the California Labor Commissioner's office. They have a webpage that provides further information abut the process.

Re: Overtime

While there are a few exceptions dependent upon your occupation, your employer must usually provide a meal period 5 hours at the latest from the time of the start of your work day and, in your case, at least two meal periods. Cutting off overtime is impermissible as well. You can file a claim yourself with the California DLSE for recovery or seek assistance from an attorney. Please feel free to call us at with any further questions.
