Legal Question in Employment Law in California

Paid while making business bank deposit (hourly worker)

I am paid by the hour, not salaried and was wondering if my employer is required to pay me when I make a nightly bank deposit after the end of the business day. I am required to drive to the bank (a 20 minute drive to bank) stand in line, and make the deposit. Since I'm paid by the hour, I feel that I am still on the clock doing company business while I'm driving to the bank with the deposit in my possession until I receive the receipt in my hand.

Yes, you are entitled to pay for all time spent making the bank deposit as well as for reasonable expenses incurred (Milage at the IRS rate per mile which is about 37-38 cents per mile).

If you are in Southern Califonria give me a call to discuss the best strategy to protect your rights as well as collect all the sums due you.

Yes, your employer is required to pay you for ANY time that you spend in performance of duties on your employer's behalf. Also, you may be entitled to mileage for the use of your vehicle in driving to the bank to make the deposit.
