Legal Question in Employment Law in California

Parking Rights

Does an employer have a right to charge for lost parking permits? I believe that replacement cards are provided to the company free of charge, but the company charges us as a "punishment".

Thank you

Re: Parking Rights

Most of the California Wage Orders provide that "No employer may make any deduction from wages or require reimbursement for any cash shortage, breakage or loss of equipment unless it can be shown that the loss is due to a dishonest or willful act or by the gross negligence of the employee" Is a parking permit "equipment?" I'm not sure, but I would consider a claim at the labor commissioner on behalf of all employees to seek a determination.

Nothing in in the law prevents your employer from charging you for the permits. It is probably the case that parking is provided as a benefit to the employees.
