Two part question

I am appealing a decision made by the California state labor commissioner. They said I was not entitled to vacation pay because I did not use it, therefore, I lost it. Per Ca. law, we do not have a use it or lose it policy, therefore, I have filed an appeal at the Superior court of Los Angeles and I am asking for the following: Unpaid vacation wages due per labor code section 227.3, plus additional wages as penalties pursuant to labor code section 203. I would also like to receive interest pursuant to Ca. labor code section 98.1 Can you please tell me how to assess/calculate the interest?

After my employment with my former employer, we verbally agreed that I would continue to work for the company as an inddpendent sales representative earning only commission from my sales. Because he has not paid me commission for my sales, I am now asking for my commission pay which he failed to pay me. On top of that, I am going to cite him for Ca. civil code 1738.15 because he failed to provide me with a written contract (which I pleaded for). I was told that under this code I could sue him for up to 3 times the commission that I am owed. How do I assess/calculate the penalties under this code? Thank you very much.
