Part Time vs Full Time

I have worked for this company at the time 2yrs 5mo they decided to close down.They offered severance packages and a choice either to relocate or take the package with the exception of a few.I was told I could stay until the completion and was told to look for other employment.So I did I found another job but it did not work out and I was asked to return to help out on a part time basis So I did from the day I came back I have been working 40+ hours a week. I talked to the human resorces person and they told me that I would be considered a reinstatment and if I paid the severance back would earn my senority back But,if I choose to keep it I would have to start from the bottom.Well its been 3mo now Im not earning vaction,sick,personal or benifets But yet Im working more then 40 hrs is this legal? I feel Im being used.

From your question, it appears your question concerns the terms and conditions of the severance agreement through which you received payment of severance benefits. To determine your rights AND obligations under the severance agreement, you must read it thoroughly. If you are unable to determine your rights and duties, it probably makes sense to consult with the Company about your concerns and questions. If you are not satisfied with the explanation, you should consult with a local employment law attorney.
