Legal Question in Employment Law in California
Partners dispute causing hostile work environment for all, what rights do I have
For four years I have worked for a small company. 2 employees and 2 owners. The owners have been in the middle of a divorce for almost two years. One of the owners has become intolerable to work with. Degrading and yelling every time they are in the office. Any mistakes made by them are blamed on the employees, with screaming and humiliation dished out.
The rules of employment have been changed with no notice. My requirements stated at job interview have been taken away. I have been paid salary, (as stated in payroll) since date of hire, with no compensation for overtime worked. I now am given a list of rules for hourly employees, (I was the only one given this list).
The other partner keeps telling us, ''maybe it will blow over''. ''If you need to work overtime for year end, clock out and I will take care of you myself''. This is redicuous. We are told to keep the peace, we stress everytime the phone rings, or a car similar to the evil partner drive into the parking lot. Do we have any rights in this situation, or is my only hope finding a different job?

Depending upon the job duties you have had, you may be entitled to overtime, but you can only go back three years. If you can determine the hours you worked, you should list them by week and file a claim with the California Labor Commissioner's office. Unfortunately, there is nothing you can do about the work atmosphere. You need to get out of there, for you own sake.
