Do they have to pay me?

An administrative assistantin in our San Francisco office has given her two week notice due to what she feels are undesireable working conditions, lack of promised traing and foul language by her superior. She has given her two week notice but her boss does not want her to stay two weeks and has indiacted that she will not get paid for thattime. If she has given the company two weeks and they opt not to take it can she still get paid for that since they are the ones not wanting her to stay? Please advise. Thank you!

Re: Do they have to pay me?

An employer is only obligated to pay an employee for "hours worked".

However, some employers enter into specific agreements to pay employees for the "noticed time of quitting".

If such is the case here, the employer may be required to pay for the two weeks.

If they accept the two weeks notice they will likely have to pay her but they dont have to accept if. They would be within their rights to let her go immediately and not wait the two weeks.
