What to do when the last paycheck doesn't come.
I left a position as a Teacher for the State of California on Sept.21,2000. I have still not received my last paycheck. I am now getting return check charges at my bank, and have found out that my auto insurance will be canceled unless this is taken care of in short order. I have made repeated calls to the facility and have received no results. I was hung up on by a clerk after she informed me that she would check her Email the next day to see if there was any word from Sacramento about my check. I have been patient as I called on October 2 and was told that I could pick up my check. When I arrived I found that it had been sent to Sacramento because of an overpayment, and that I could not receive any advance of funds because I am now classified as a Separated Employee. I was then told to wait a week, which I did, and am now told that no one knows anything about my check. The "check" I am waiting for includes my pay for a month, vacation time that was accumulated, and the funds withheld in my PERS account. What can I do about the charges that are interred because of the delay in getting my paycheck? How do I go about filing on this without spending money that I obviously don't have?

You need to contact the local office of the California state labor commissioner. They will get you your money and possibly make the employer to a penalty to you in addition to that.
