Legal Question in Employment Law in California

paychecks

I am currently working as a server. The company just sold it to another company that I now work for. The first paycheck that I received was all cash no taxes taken out or anything. The second check was in a form of a check but it was also tax free. Now we are going on the third check and now are going to be paid a day late. What procedures or claims can I do, to protect myself? I don't want to go into work until I receive my paycheck.

You and your co-workers will not get credit for unemployment benefits, state disability and social security, for wages paid "under the table." If you continue working, keep careful records of your work hours and the sums paid you. Review your pay stub to confirm you have been paid in full. Contact the Employment Development Department and report the failure to make proper deductions and probably failure to pay any payroll taxes to the state and feds.
