Legal Question in Employment Law in California
Can a person be denied employment even after a felony conviction is removed and
Just recently, my mother was hired at this well know company, under these conditions:
That she get a felony conviction from 15 yrs. ago reduced to a misdemeanor.
In the meantime, she went through all the training/classes and received her degree, attended seminars, conferences, purchased all the necessary literature and did everything else that was required of her so when the court situation was resolved, she would already be ahead of the game, so to speak.
She apppeared before the judge and after looking over her record that had no other convictions or traffic violations of any kind other than the incident 15 years prior, his final ruling was that her case be ''Expunged''.
As per the companies request, she hand delivered the certified documents from the court house to the company and they tell her, 'We do not hire felons!'(In so many words). After they can see that her record is completely clean.
Can they legally do this after all that she has invested already?

Without some written agreement, it is difficult to force a company to hire an employee. The good thing the felony is expunged and she can go on with her life as a non-felon.
