Legal Question in Employment Law in California

physical aggression

After two promotions one retaliatory demotion and one

and a half years of comments and insinuations about

my marital status, ridicule over the demotion etc. I was

fired (12/19/02) after complaining of what I feel was

physical aggression by the manager of the department

I was in .

early november

Upon rushing into the maintenance shop yelling ''feet

off the f**king desk'' and finding me at the dirty shop

desk with my feet up on it, this manager physically

grabbed my legs in both of his arms and lifted my legs

high enough to make me loose balance in the chair

and almost fall back on to the floor . Then he slammed

my feet to the ground. It was humiliating and

demeaning.He gave me no time to respond to his

yelling. (This fellow is 30ish very large and I am fifty

years old)

Was the physical action illegal and do I have recourse?

I have been looking for work and am on unemployment.

Just before firing me he hired two younger men into the

department.

This was after three years eight months of hard work

for a major specialty retailer. The whole incident was

traumatic.

from the facts given so far, you definitely appear to have several causes of action available to you, i.e. assault, battery, infliction of emotional distress, wrongful termination, etc..

you seem to have a very strong case against your former employer, and/or this person who assaulted you personally. if you can email me more detailed information on what all you have gone thru, i can better assist you and/or offer legal representation to help you get justice here.
