Pregnancy Disability Leave

My wife was notified on her last day of work (prior to maternity leave) that her employer was not paying for her group health insurance during her leave. We would have to pay.

Seven years ago, another employee had her insurance covered during maternity. There is no policy in the office manual.

The employer employs less than 50 employees so most federal and state acts/regulations don't apply.

What is she entitled to during her leave?

Employers who deprive women of benefits other employees are entitled to, solely because they are taking maternity leave are discriminating against them. This is illegal. If you cannot resolve this directly with the employer, seek the assistance of an employment law attorney or contact the Department of Fair Employment and Housing. All employers with 5 or more employees are covered in California.
