Legal Question in Employment Law in California

Prevailing Wage Scam

I own a construction company and I just heard through rumors that one of my sub-contractors dosen't pay prevailing wages. If not, they have lied and filed false reports to me. Is my company liable if they are reported if they are my sub-contractor? How can I protect my company from this bad attention.

Re: Prevailing Wage Scam

You will probably have to hire a lawyer to contact the company to attempt to straighten out this issue. Based on your statement, they have committed fraud on you as well as the State of California. The DLSE has jurisdiction over prevailing wage issues and could audit this company if it is brought to their attention. You will probably have to take preemptive measures to avoid liability, especially since you now know your subcontractor was violating the law.
