What questions can I legally ask an applicant's previous employer when performing a reference check?

You can ask a prior employer whatever you want. The prior employer, on the other hand, may wish to disclose only the prior employee's dates of employment in order to avoid an action for defamation. The prior employer may also warn you of any wrongful or negligent act by the employee in order to protect itself from any negligence action by you or by another person who the employee causes injury to while he is working for you.
